Serbia: The State of Emergency Has Been Lifted

On May 6, 2020, the National Assembly of the Republic of Serbia has passed the Decision on the abolition of the state of emergency ("Decision"), which entered into force on May 7, 2020.

The relevant Decision abolished the state of emergency in the Republic of Serbia, which was declared on March 15, 2020.

On the same day, the National Assembly of the Republic of Serbia passed the Law on the validity of regulations, which the Government, with the co-signature of the President of the Republic, made during the state of emergency and which the National Assembly confirmed ("Law").

The Law regulates the validity of regulations issued during a state of emergency, and certain regulations expire on May 7, 2020, namely:

  • Regulation on measures during a state of emergency;
  • Regulation on organizing the work of the employer during the state of emergency;
  • Regulation on tax measures during the state of emergency in order to mitigate the economic consequences caused by the COVID-19 disease caused by the SARS-CoV-2 virus;
  • Regulation on the use of financial resources of the budget of the Republic of Serbia during the state of emergency caused by the disease COVID-19 caused by the SARS-CoV-2 virus;
  • Regulation on deadlines in court proceedings during the state of emergency declared on March 15, 2020;
  • Regulation on limiting the retail price of protective equipment during the state of emergency caused by the COVID-19 disease caused by the SARS-CoV-2 virus;
  • Regulation on the Specific Technical Requirements, Standards and Application of Medical Devices for the Emergency of COVID-19 Disease Caused by the SARS-CoV-2 Virus;
  • Regulation on the manner of participation of the accused in the main trial in the criminal proceedings held during the state of emergency declared on March 15, 2020;
  • Regulation on additional borrowing during the state of emergency caused by the COVID-19 disease caused by the SARS-CoV-2 virus by taking loans, issuing government securities on the domestic and international financial markets and providing guarantees of the Republic of Serbia;
  • Regulation on organizing the work of social protection institutions for accommodation of beneficiaries and social protection organizations for providing home accommodation services during a state of emergency; as well as
  • Regulation on the documents required to accompany goods in transit during the emergency caused by COVID-19 caused by the SARS-CoV-2 virus.

The provisions of the named regulations shall apply only to the perpetrators of the offenses prescribed by those decrees, which were committed during the state of emergency.

Other regulations issued during the state of emergency will be valid until the day the relevant laws enter into force.
